This course offers a review of all aspects of wetlands regulation, focusing on Section 404 of the Clean Water Act. Topics include the jurisdictional scope of section 404, how permitting decisions are made, and the substantive requirements that Section 404 permits impose. The course also considers how Section 404 is enforced, and how its requirements intersect with private property rights.
